A Proposed End to Anchor Baby Citizenship

Thanks to the Patriot Post for excellent and in depth reporting on this issue. Excerpts from the Post offered below.

Rep. Nathan Deal (R-GA) is proposing an end to “birthright citizenship,” the practice that allows any child born on U.S. soil to become a citizen automatically, regardless of the status of the parents… {This strategem has been used by} illegal immigrants looking to gain a legal foothold in the U.S…Deal’s proposal would allow babies born in the U.S. to be granted automatic citizenship if at least one parent is a U.S. citizen or national, a legal permanent resident of the U.S., or actively serving in the U.S. military.

Contrary to commonly held belief, the 14th Amendment does not confer citizenship on the children of illegal aliens born on U.S. soil. Birthright citizenship “began with the Supreme Court decision of United States v. Wong Kim Ark (1898). The Supreme Court of the United States ignored congressional intent… {in finding that the child was a citizen. And the child in the case was that of legal immigrant parents.}

Congressional intent is known because:

In the Senate debate on the 14th Amendment (39th Congress, First Session), a provision for ‘anchor babies’ was never the intent of Congress.” Sen. Jacob Howard (R-MI) argued for adding the phrase “subject to the jurisdiction thereof” to the Amendment, saying, “This [Amendment] will not, of course, include persons born in the United States who are foreigners, aliens, who belong to the families of ambassadors, or foreign ministers…”

Thus, the issue of “families being separated by deportation” which is used to justify amnesty for all illegal alien parents is entirely a red herring.  There should be no citizenship to speak of at all.  Those who have taken an oath to protect and defend the Constitution should do exactly that.
